I. Definitions

In these General Terms and Conditions, “we”, “us”, and “our” refer to sellings.ch, while “you” and “your” refer to the customer.

II. Scope of the Terms and Conditions

The customer acknowledges and agrees to these General Terms and Conditions upon placing an order. These Terms and Conditions govern the contractual relationship between sellings.ch and its customers. Both parties accept them without reservation.

These General Terms and Conditions apply from the moment the contract is concluded (see Section IV). Amendments and ancillary agreements shall only be valid if confirmed by us in writing. Furthermore, sellings.ch reserves the right to amend these Terms and Conditions at any time.

III. Prices

All prices are stated in Swiss Francs (CHF) and include VAT. Delivery charges are not included.

The amount charged to the customer corresponds to the price shown in the order confirmation, which also includes shipping costs and any applicable discounts. The prices listed in the order confirmation are binding for both parties, including in cases where there is a difference between the order date and the delivery date.

If a product price has been incorrectly displayed due to a billing or technical error, sellings.ch reserves the right to adjust the price after consultation with the customer or to cancel the order.

IV. Conclusion of Contract

A binding order is considered concluded once the customer clicks the “Buy” button on the final order page of sellings.ch. By doing so, a contract is formed between the customer and sellings.ch.

By submitting an order, the customer makes an offer to purchase the selected product(s). We reserve the right to accept or reject this offer. sellings.ch confirms acceptance of the order and further order details via the email address provided by the customer during registration.

The customer has no right of withdrawal or cancellation. In exceptional cases, sellings.ch may agree to a cancellation subject to a cancellation fee.

The order becomes legally binding once the customer receives a confirmation email from sellings.ch or Heylight, or a confirmation message via Instagram or WhatsApp. Such confirmation constitutes acceptance of the customer’s offer.

If errors occur in the recipient information provided by the customer (e.g., incorrect address), sellings.ch cannot be held responsible for any resulting non-delivery of the ordered goods.

By placing an order, the customer confirms that they are at least 18 years old. The accuracy of the email address and telephone number is the sole responsibility of the customer.

All offers are non-binding until the ordering process has been fully completed.

The operator expressly reserves the right to modify, supplement, delete, or temporarily or permanently discontinue parts of the website or the entire offering without prior notice.

If the customer places an order via social media platforms (Instagram/Facebook), the following additional provisions apply:

Products displayed on sellings.ch’s social media accounts constitute offers by sellings.ch. However, a contract is not concluded merely through initial contact by the customer. A contract is only concluded once sellings.ch sends the customer a delivery note or invoice via email.

These General Terms and Conditions are deemed accepted once the customer receives the confirmation email.

Customers placing orders via social media may also arrange installment payment plans. The provisions relating to installment plans shall apply accordingly.

Where payment processing is carried out through external payment service providers, the customer also agrees to the respective provider’s General Terms and Conditions. These can be viewed on the relevant provider’s website.

V. Products

Photos of products sold by sellings.ch are not part of the contractual agreement. If deviations from the actual products occur, sellings.ch assumes no responsibility. Minor deviations are possible.

Before purchasing, the customer must verify the compatibility of the products. sellings.ch disclaims any liability in this regard.

Product descriptions are provided for informational purposes only and do not constitute advice or guarantees.

Products are sold without any road traffic approval certificate. If the road traffic authority requires certification, the customer is solely responsible for obtaining such certification externally. sellings.ch will not bear any costs arising from obtaining such certification.

Custom-made products cannot be returned or refunded.

As products are handmade, slight deviations from sample photos may occur. Unless there are major processing defects, such as an incorrect color, the contract shall be deemed fully performed.

Payments may not be withheld due to items delivered late because of shipping delays.

If the steering wheel is resold privately, sellings.ch disclaims all liability and warranty obligations.

VI. Shipping Costs

Shipping within Switzerland is free of charge.

Depending on the product, express delivery may be available at an additional charge. Prices include packaging materials.

sellings.ch does not cover customs duties. Any customs duties are the sole responsibility of the customer.

VII. Delivery

Orders are processed within one business day after receipt of payment.

Estimated delivery times are as follows:

  • Standard: 7–10 business days
  • Express: 2–3 business days (optional for selected products)
  • Custom-made products: 14–28 business days

Delivery times are estimates only and may vary. Delays do not entitle the customer to any claims against sellings.ch.

The purchased item shall be delivered to the customer’s place of residence.

The customer bears the risk of accidental loss or deterioration of the purchased item.

If the customer delays acceptance of the purchased item, sellings.ch may either withdraw from the contract immediately and claim damages or continue to demand acceptance.

VIII. Payment Processing

Payment processing may be carried out by sellings.ch or by one or more external payment service providers (“service providers”).

The service provider may handle invoicing, payment processing, and debt collection on behalf of sellings.ch. The customer agrees that the data necessary for payment processing may be shared with the service provider.

By selecting a corresponding payment method, the customer also agrees to the General Terms and Conditions of the respective service provider.

Payment may either be made as:

  • a one-time payment of the full amount, or
  • through an installment plan of up to 24 monthly installments.
One-Time Payment

Invoices must be paid within the period stated on the invoice. If payment is not made on time, the customer automatically falls into default.

  • After five days, a payment reminder will be sent by email.
  • If payment remains outstanding, a first reminder will be issued five days later (additional fee: CHF 20.00).
  • If payment is still outstanding, a second reminder will be issued five days after the first reminder (additional fee: CHF 20.00).

If payment remains outstanding after the second reminder, the claim may be transferred to Payment Support GmbH for further processing.

From the moment the claim is transferred, processing shall follow the procedures and General Terms and Conditions of the appointed service provider. This includes additional reminders, fees, and debt collection measures.

The customer shall bear all costs resulting from late payment, including the costs of any debt collection agency within the scope permitted by law. The calculation may be based on the recommendations of the Association of Swiss Debt Collection Companies (VGIS). Additional legally permissible costs remain reserved.

Payment Support GmbH is entitled to carry out all debt collection measures, including debt enforcement proceedings.

Default interest pursuant to Article 104 of the Swiss Code of Obligations and other legally permissible costs may also be charged.

Installment Plans

Customers wishing to pay in installments must notify sellings.ch accordingly.

Within five days after placing the order, the customer must register on the payment provider’s portal and complete the order. The customer will receive the portal link via SMS immediately after placing the order.

If the credit check is negative, the customer must provide sellings.ch within five days with email confirmation of a standing payment order covering the full amount in favor of sellings.ch.

If proof of the standing order is not provided, sellings.ch has the right to terminate the contract and withhold delivery without further justification.

sellings.ch may terminate an installment plan at any time if the customer fails to pay an installment on time. In such cases, the entire outstanding balance becomes immediately due.

Each installment is due on the agreed date. Failure to pay on time automatically places the customer in default, and the claim will then be processed according to the provisions above.

The installment plan also constitutes an acknowledgment of debt pursuant to Article 82 of the Swiss Debt Enforcement and Bankruptcy Act (SchKG).

If the customer’s credit assessment is negative, the installment plan may be reduced to a maximum of 12 installments.

A one-time fee of CHF 100.00 is charged for the removal of a debt enforcement entry. This fee is payable by the customer.

Communication regarding payment processing and debt collection may be carried out by sellings.ch or its service providers electronically (e.g., via email or SMS). Notifications are deemed delivered once sent to the customer’s last known email or contact address, regardless of whether they were actually read.

IX. Liability

These General Terms and Conditions define all obligations and responsibilities in full. We are not bound by any guarantees, business conditions, or other provisions not expressly stated herein.

sellings.ch is not liable for errors caused by garages during installation or wiring (e.g., LED cable wiring). sellings.ch is also not liable for consequential damages resulting from incorrect wiring.

The customer undertakes to have the products installed by a professional garage and/or qualified specialist.

If the customer is involved in a traffic accident, all liability of sellings.ch is excluded to the extent permitted by law.

If the steering wheel is used on public roads (rather than on a racetrack), the customer is solely responsible for clarifying and carrying out any required registrations or approvals with the road traffic authority.

sellings.ch assumes no liability for delivery delays.

The customer bears the risk of transport damage unless claims can be made directly against the transport company. The transport company is liable for incorrectly deposited packages.

sellings.ch assumes no liability for transport defects.

sellings.ch accepts no responsibility for loss of functionality, error messages, malfunctions, or electronic impairments of the vehicle caused by installation or use of the steering wheel (e.g., steering wheel heating, vibration, lane assist systems, etc.).

All products are tested for functionality before shipping.

Installation of delivered products is carried out at the customer’s own risk. sellings.ch will not cover installation costs.

Except where expressly stated otherwise, liability for contractual breaches is excluded to the extent permitted by law. This exclusion does not apply where sellings.ch has expressly guaranteed certain product characteristics or fraudulently concealed defects.

The provisions relating to warranty claims remain reserved.

X. Warranty Claims

sellings.ch grants customers a one-year warranty from the date of contract conclusion for the stitching of steering wheels.

Warranty claims apply exclusively to the stitching of sports steering wheels.

The customer must prove that the defect originated from sellings.ch. Wear and tear or damage caused by the customer or during installation are excluded from warranty coverage.

sellings.ch reserves the right to decide individually on warranty claims and may reject any warranty claim.

Defects or warranty requests must be submitted exclusively via email to info@sellings.ch. Telephone inquiries or requests via social media are not accepted.

sellings.ch also reserves the right to grant additional warranty services at its discretion. Such services must be confirmed in writing and shall otherwise follow the same conditions as the stitching warranty.

XI. Inspection and Notification Obligations

Any claims arising from defects identifiable during normal inspection are forfeited unless the customer reports them to sellings.ch within five days after delivery at the place of performance.

Claims arising from other defects are forfeited unless reported within five days after discovery, and no later than one year after delivery.

XII. Retention of Title

The goods remain the property of sellings.ch until all payments arising from the contract have been received in full.

If the customer defaults on payment, sellings.ch is entitled to register the retention of title in the retention of title register at the customer’s expense.

XIII. Data Protection

Only data necessary for processing the order or data submitted via the contact form will be collected.

Personal data is processed for the purpose of fulfilling contractual or pre-contractual rights and obligations.

Stored data will be retained until the agreed service has been properly fulfilled.

Swiss data protection law (DSG) applies. sellings.ch acts as the data controller.

The customer has the right to access, correct, delete, restrict processing of, object to processing of, and transfer personal data.

XIV. Copyright

All copyrights and other rights relating to content, images, photos, or other files on this website belong exclusively to sellings.ch or the specifically named rights holders.

Written consent from the copyright holder must be obtained in advance for reproduction of any elements.

XV. Severability Clause

Should any provision of these General Terms and Conditions be invalid, incomplete, or impossible to perform, the validity of the remaining provisions shall remain unaffected.

XVI. Applicable Law and Jurisdiction

The place of jurisdiction for all disputes arising from the contract and these General Terms and Conditions is Zurich 1.

Swiss substantive and procedural law shall apply exclusively.
